Biography:

Graduated from Ohio Northern University in 1984 and was licensed to practice law in North Carolina the same year. He became at Ganly & Ramer in 1989 and began to focus his practice in the area of Workers Compensation and Personal Injury. Since that time, he has represented thousands of injured workers and individuals. Not afraid of fighting for his client’s rights, Tom has litigated over 200 workers compensation cases to decision with the North Carolina Industrial Commission and litigated over 35 cases to the North Carolina Court of Appeals and Supreme Court. Some of his representative litigation and appellate results include:

  • Blackwell v. North Carolina Department of Public Instruction , 282 N.C. App. 24, 870 S.E.2d 556  (2023) which established the legal precedent that a permanent and totally disabled claimant could be eligible for a lump sum award of benefits.
  • Vance v. The Laurels, 2022-NCCOA-25  (2022)  which reversed the Industrial Commission and held lifting an excessively heavy patient by a physical therapist assistant was not part of her normal job and therefore compensable.
  • Ball v. Bayada Healthcare , 803 S.E.2d 692 (2019) which held an employee’s weekly benefits could be based on their future earnings where they had received a significant pay raise immediately prior to their injury.
  • Holiday v. Tropical Fruit and Nuts , 242 N.C.App. 562, 775 S.E.2d 885 (2015) which held injuries sustained at mandatory company recreational outing was compensable.
  • Cawthorn v. Mission Health, 221 N.C. App. 42, 712 S.E.2d 306  (2011)  which held the employer hospital had engaged in fraudulent behavior in denying a 20 year nurse’s back injury claim and was assessed $30,000 of attorney fees sanctions.
  • D’Aquisto v Mission Health 171 N.C. App. 216 (2005) which held a sexual assault of a staff member by a third party contractor was compensable arising out of her employment.

Tom has been recognized as a Preeminent Attorney since 2005, a member of the Million Dollar Advocates since 2000, the Super Lawyers, and has served on the North Carolina Bar Association Workers Compensation Council and the Workplace Injury Litigation Group executive council.
